1. Agreement to Terms

By accessing and using the TestMy.AI website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all visitors, users, and others who access or use the Service provided by CCB AI Solutions (CCB YAPAY ZEKA YAZILIM VE TEKNOLOJİ DANIŞMANLIĞI LİMİTED ŞİRKETİ).

TestMy.AI provides AI security testing, accuracy validation, and continuous monitoring services for artificial intelligence systems. Our services include but are not limited to:

  • Black Box Security Testing for AI systems
  • White Box Accuracy Testing and validation
  • Continuous monitoring and governance services
  • AI risk assessment and consultation
  • Educational resources and best practices documentation

3. Use of Service

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service. By using the Service, you represent and warrant that you meet these requirements.

3.2 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation
  • Transmit any malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the Service or servers

  • Service level agreements (where applicable)

4.2 Client Responsibilities

Clients engaging our services agree to:

  • Provide necessary access to AI systems for testing (where applicable)
  • Supply required documentation and golden QA test sets
  • Respond to information requests in a timely manner
  • Maintain appropriate security measures for shared credentials
  • Use our reports and findings in accordance with agreed terms

5. Intellectual Property Rights

5.1 Our Content

The Service and its original content, features, and functionality are owned by CCB AI Solutions and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 Client Data

You retain all rights to your AI systems, data, and confidential information shared with us. We will only use such information to provide the agreed services and as outlined in our Privacy Policy.

5.3 Testing Methodologies

Our testing methodologies, frameworks, tools, and proprietary processes remain our intellectual property. Reports and findings are provided for your internal use only and may not be redistributed without permission.

6. Confidentiality

We understand that clients may share sensitive information about their AI systems. We commit to:

  • Maintain strict confidentiality of all client information
  • Use information solely for providing agreed services
  • Implement appropriate security measures to protect data
  • Not disclose client information to third parties without consent
  • Return or destroy confidential information upon request (subject to legal obligations)

7. Disclaimers and Limitations of Liability

7.1 Service Provided "As Is"

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 No Guarantee of Results

While we employ industry-standard testing methodologies, we cannot guarantee that all vulnerabilities or issues will be discovered. AI testing is complex, and new vulnerabilities may emerge after testing is completed.

7.3 Limitation of Liability

To the maximum extent permitted by law, CCB AI Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any bugs, viruses, or harmful code transmitted through the Service
  • Any errors or omissions in content or for any loss or damage incurred as a result of the use of any content
  • Security incidents that occur after testing is completed

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless CCB AI Solutions, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any misuse of our reports or findings

9. Service Availability and Modifications

9.1 Service Changes

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

9.2 Updates to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Fraudulent, abusive, or illegal activity
  • At your request

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including but not limited to confidentiality obligations, warranty disclaimers, and limitations of liability.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

12. International Use

We make no claims that the Service is accessible or appropriate outside of Turkey. If you access the Service from other locations, you do so at your own risk and are responsible for compliance with local laws.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any separate service agreements, constitute the entire agreement between you and CCB AI Solutions regarding the Service and supersede all prior agreements and understandings.
